Your question
was whether the Board of Commissioners could revise the Historic
Preservation Revolving Fund Capital Project Ordinance to allow some of the
monies in such fund to be used to pay some operating expenses of the HLC.
The answer
from a legal standpoint is yes, it would be legal for the Board to make
that change. I have checked with Bond Counsel and it does not cause a
problem from a bond standpoint, nor does it cause a problem from a general
local government law standpoint.
If this is a
change that you will be proposing, please work with Sara Heasley on
getting you a draft amendment to the Capital Project Ordinance to attach
to your request to the Board.
