Item # 1 - Approval of Minutes

MS. HOCKETT PRESENTED A MOTION SECONDED BY MS. JOHNSON-GESS THAT THE HLC MINUTES FOR AUGUST 9, 2004, BE APPROVED AS DISTRIBUTED. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

MS. HOCKETT PRESENTED A MOTION SECONDED BY MR. NORMAN THAT THE HLC’S EXECUTIVE SESSION MINUTES FOR AUGUST 9, 2004, BE APPROVED AS DISTRIBUTED. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Item #2 - Chairman’s Report: Mr. Bradsher

Mr. Bradsher welcomed everyone to the meeting. Mr. Bradsher told the Commissioners that Mr. John Parker has resigned from the HLC effective upon the Mayor’s reappointment to his seat. He extended many thanks to Mr. Parker for his years of outstanding service as a member of the HLC.

Mr. Bradsher said that the HLC has received a reminder from Bev Merritt of the City Clerk’s office that City Appointees will receive a warning letter from the City Clerk’s office if two meetings in a row are missed. If three meetings in a row are missed, City Council automatically removes the appointee.

Mr. Bradsher reported that a public hearing will be held October 18th in Huntersville to consider historic designation for the Samuel J. McElroy House, 10915 Beatties Ford Road, and the Oehler Farm (155 acres.) Ms. Smith is in charge of attendance for public hearings. She told the HLC that Groups B & C are scheduled to attend this hearing as HLC representatives.

Item #3 - Director’s Report: Dr. Morrill

Dr. Morrill said that the HLC is required as part of the Certified Local Government program to hold a public hearing and to comment on the prospective listing of the Rozzell House and property in the National Register of Historic Places. He said that the HLC should formally vote to open the public hearing to hear anyone who wishes to speak to this issue. Public notice of the hearing has appeared in the Charlotte Observer.

MR. NORMAN PRESENTED A MOTION SECONDED BY MS. SMITH THAT THE HISTORIC LANDMARKS COMMISSION OPEN THE PUBLIC HEARING AND RECEIVE INPUT FROM THE PUBLIC ABOUT THE ROZZELL HOUSE AND PROPERTY. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

The Public Hearing was held. No one from the public was present to speak about the property.

MS. SMITH PRESENTED A MOTION SECONDED BY MR. NORMAN TO CLOSE THE PUBLIC HEARING AND NOTIFY THE STATE HISTORIC PRESERVATION OFFICE THAT THE ROZZELL HOUSE, 11647 ROZZELLES FERRY ROAD, CHARLOTTE, N. C., MEETS THE CRITERIA FOR LISTING IN THE NATIONAL REGISTER OF HISTORIC PLACES. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Dr. Morrill reported that the Charlotte City Council is scheduled to consider the designation of the Lloyd Presbyterian Church Cemetery at an upcoming meeting. He said that HLC staff did meet with Mr. Clay Grubb to discuss the situation. The exact boundaries of the land are to be slightly modified, but no grave sites will be impacted. Dr. Morrill said that Ms. Hope Murphy, the UNCC graduate student who wrote the Survey and Research Report on the property, can assist with the development of an interpretation scheme for the graveyard and generally assist with coordination with Grubb Properties.

MS. JOHNSON-GESS PRESENTED A MOTION SECONDED BY MS. HOCKETT THAT HOPE MURPHY BE PAID $12.00 PER HOUR AS AN HLC CONSULTANT TO WORK FOR A MAXIMUM OF 200 HOURS TO COORDINATE WITH GRUBB PROPERTIES AND TO DEVELOP AN HISTORIC INTERPRETATION PROGRAM FOR THE LLOYD PRESBYTERIAN CHURCH CEMETERY. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Dr. Morrill reported that several properties are being processed for historic designation and that public hearings will be forthcoming. Specifically, the McElroy farm land and the Oehler Farm will be considered by the Town Board of Huntersville on October 18th. The Davidson Cotton Mill will be considered by the Davidson Town Board in November, but no definite date has been set. The HLC can anticipate a joint public hearing with the Charlotte City Council in December to consider the McConnell farm, the Builders Building, and the Hennigan Place land if the HLC votes to recommend designation. HLC Staff is checking with the Town of Matthews to determine whether a public hearing is necessary for the designation of the interiors of the Funderburk blacksmith shop and grist mill.

Dr. Morrill reported that he met with the Matthews Town Board of Commissioners on September 7th to discuss the possibility of undertaking a collaborative effort to preserve the Bost House on West John St. in Matthews. The Town Board will be issuing a letter of intent to the Commission saying that in concept it supports providing one-half of the funds to purchase and restore the house for eventual resale. The Town of Matthews will be approaching the owner to determine his willingness to sell. HLC Staff will be working with the Projects Committee as this matter moves forward.

Dr. Morrill reported that HLC Staff is scheduled to meet on September 20th with the Huntersville Town Board to explain the concept of a collaborative project to purchase, rehabilitate, and sell the Jordan Farm on Hus McGinnis Road. HLC Staff will be working with the Projects Committee as this matter moves forward.

Dr. Morrill said that he will appear before the County Park and Recreation Commission on September 14th to explain the HLC’s interest in moving the Bethesda School to Rural Hill and restoring it as a historic site. This is in preparation for making an appearance before the Board of County Commissioners at an upcoming meeting.

Dr. Morrill reported that discussions were held with the staff of the Building Standards Department concerning enforcement of design review regulations. The Building Standards Department has identified the problem. It has to do with individual historic landmarks that have multiple addresses, such as the Charlotte Cotton Mills. Staff will be providing information hereafter for all addresses associated with individual historic landmarks.

Dr. Morrill reported that if the HLC votes to fund Survey and Research Report on the Rowland-Clay House and the McQuay House, two UNCC graduate students, Ms. Hope Murphy and Mr. Paul Archambault, can do the reports at $1,500 each. Dr. Morrill said that he will review the reports to make sure they are in proper order. Motions will be presented under the Survey Committee’s Report.

Dr. Morrill reported that Mr. Paul Archambault will be completing the comprehensive survey of Pineville. HLC Staff will schedule a meeting with the Pineville Town Board to present the results, including recommendations. The Survey will be presented at the October 7th meeting of the Survey Committee and will be brought to the Commission at its regular October meeting.

Dr. Morrill reported that he and Mr. Stewart Gray are concluding the Center City Charlotte Survey. The Survey Committee will take action on the survey over the next several months. The Charlotte Observer has given good coverage of the Survey.

Dr. Morrill said that Mr. Pappas and Mr. Finger of Pappas Properties are present to discuss Charlotte Cotton Mills business and have asked to be placed on the Agenda at this point.

MS. HOCKETT PRESENTED A MOTION SECONDED BY MS. SMITH THAT THE HISTORIC LANDMARKS COMMISSION CONVENE IN EXECUTIVE SESSION. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

MR. NORMAN PRESENTED A MOTION SECONDED BY MS. HOCKETT THAT THE HISTORIC LANDMARKS COMMISSION RECONVENE IN REGULAR SESSION. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Note: During Executive Session the HLC voted on assignment and additional purchases of parking spots at the Charlotte Cotton Mills, approved a purchase contract on a part of the building, and voted on a new selling price for the Sidney and Ethel Grier House. Mr. Kluttz left the meeting at this point - 6:50 p.m.

Item #4 - Design Review Committee Report: Ms. Hockett

Ms. Hockett reported that the Design Review Committee met August 24, 2004 at 8:00 a.m. at the HLC office. Minutes from the meeting can be found on the HLC’s website - cmhpf.org - and are also on file at the HLC office.

THE DESIGN REVIEW COMMITTEE PRESENTED A SECONDED MOTION THAT THE APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS FOR BUILDING "A" OF THE CHARLOTTE COTTON MILLS, 506 W. 5TH STREET, CHARLOTTE, N. C., BE ACCEPTED AS PRESENTED. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

THE DESIGN REVIEW COMMITTEE PRESENTED A SECONDED MOTION THAT THE APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS FOR THE MOORE-GOLDEN HOUSE, 1701 E. 8TH STREET, CHARLOTTE, N. C., BE APPROVED AS PRESENTED, WITH THE EXCEPTION THAT NO APPROVAL IS INCLUDED FOR THE ADDITION OF A MASTER BATHROOM OR CHANGES TO BEDROOM NO. ONE AS DEPICTED IN THE PLANS ACCOMPANYING THE APPLICATION. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

The owners of the Moore-Golden House were present in support of the Application for a Certificate of Appropriateness. Ms. Hockett expressed the sadness we all share regarding the theft of several fireplace surrounds from the house a couple of weeks ago.

Item #6 - Survey Committee Report: Mr. Norman

Mr. Norman reported that the Survey Committee met Thursday, September 2, 2004, at the HLC office at 6:00 p.m. Minutes can be found on the HLC’s website - www.cmhpf.org - and are on file at the HLC office.

THE SURVEY COMMITTEE PRESENTED A SECONDED MOTION THAT THE McCONNELL HOUSE, 4009 BEATTIES FORD ROAD, CHARLOTTE, N. C. (INTERIOR, EXTERIOR AND ENTIRE TAX PARCEL) BE PROCESSED FOR HISTORIC DESIGNATION. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

MR. NORMAN PRESENTED A MOTION SECONDED BY MS. SMITH THAT THE HINSON STORE, 8925 ARLINGTON CHURCH ROAD, MINT HILL, N. C. BE TABLED FOR CONSIDERATION FOR HISTORIC DESIGNATION. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Note: The owners have voiced opposition to historic designation of the Hinson Store.

THE SURVEY COMMITTEE PRESENTED A SECONDED MOTION THAT THE BUILDERS BUILDING, 312 WEST TRADE STREET, CHARLOTTE, N. C. (EXTERIOR OF BUILDING ONLY) BE PROCESSED FOR HISTORIC DESIGNATION. THE COMMISSION APPROVED THE MOTION WITH MS. HOCKETT ABSTAINING.

Note: First Presbyterian Church owns the land on which the building sits and does not oppose the designation of the exterior of the building.

THE SURVEY COMMITTEE PRESENTED A SECONDED MOTION THAT THE RENFROW-LEMMOND HOUSE, 344 WEST JOHN STREET, MATTHEWS, N. C., BE PLACED ON THE HLC’S STUDY LIST. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

THE SURVEY COMMITTEE PRESENTED A SECONDED MOTION THAT McAULEY ROAD, MECKLENBURG COUNTY (HUNTERSVILLE AREA), N. C., BE PLACED ON THE HLC’S STUDY LIST. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Note: The McAuley House is on the HLC’s Study List. The McAuley Road is one of only a few dirt roads left in Mecklenburg County.

THE SURVEY COMMITTEE PRESENTED A SECONDED MOTION THAT 5. 4 ACRES OF LAND SURROUNDING HENNIGAN PLACE, 3503 TILLEY MORRIS ROAD, CHARLOTTE, N.C ., A DESIGNATED HISTORIC LANDMARKS, BE PROCESSED FOR HISTORIC DESIGNATION. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Note: Hennigan Place, an 1845 Greek Revival house, was designated historic in 1980. Betty and Peter Snow are the long-time owners.

THE SURVEY COMMITTEE PRESENTED A SECONDED MOTION THAT THE FENNELL HOUSE, 301 E. KINGSTON AVE., CHARLOTTE, N. C., BE PLACED ON THE HLC’S STUDY LIST. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Note: This house is in the Dilworth Historic District which provides protection, but the house may have been designed by C. C. Hook which could make it of special historic significance.

THE SURVEY COMMITTEE PRESENTED A SECONDED MOTION THAT THE ELIZABETH LAWRENCE HOME AND GARDEN, 348 RIDGEWOOD AVE., CHARLOTTE, N. C., BE PLACED ON THE HLC’S STUDY LIST. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Note: Elizabeth Lawrence was a noted author and journalist who possessed expertise in ornamental gardening. The property derives its significance primarily from the garden.

THE SURVEY COMMITTEE PRESENTED A SECONDED MOTION THAT THE McQUAY HOUSE, 3200 TUCKASEEGEE ROAD, CHARLOTTE, N.C., BE HLC FUNDED ($1,500) FOR A SURVEY AND RESEARCH REPORT. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Note: The McQuay House is a rare example of a late nineteenth farmhouse on the western fringes of Charlotte.

THE SURVEY COMMITTEE PRESENTED A SECONDED MOTION THAT THE ROLAND-CLAY HOUSE, 606 E. CHARLES STREET, MATTHEWS, N. C., BE HLC FUNDED ($1,500) FOR A SURVEY AND RESEARCH REPORT. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Note: This house was identified during the HLC’s 2002 survey of African-American historic resources and has been found eligible for the National Register of Historic Places. The house is significant for its masonry construction and as one of the few surviving historic African-American homes in Matthews. The owner desires historic designation.

THE SURVEY COMMITTEE PRESENTED A SECONDED MOTION THAT MARTIN’S GROCERY (CURRENTLY LUPIE’S RESTAURANT), 2718 MONROE ROAD, CHARLOTTE, N. C., NOT BE PROCESSED FOR HISTORIC DESIGNATION AT THIS TIME BUT THAT THE PROPERTY CONTINUE TO BE MONITORED FOR ENDANGERMENT. ALL COMMISSIONERS PRESENT APPROVED THE MOTION WITH MS. JOHNSON-GESS AND MR. BRADSHER CASTING OPPOSING VOTES.

MR. NORMAN PRESENTED A MOTION SECONDED BY MS. JOHNSON-GESS THAT HLC STAFF MONITOR MARTIN’S GROCERY, 2718 MONROE ROAD, CHARLOTTE, N. C. FOR ENDANGERMENT. THE COMMISSION UNANIMOUSLY APPROVED THE MOTION.

Item #7 - Education Committee Report: Ms. Lewis

Ms. Lewis reported that the Education Committee meeting scheduled for August 25, 2004, was canceled due to the fact that the History Channel coordinator was unable to attend the meeting. She said that Charlotte Trolley, Inc., will inform the HLC when another meeting is scheduled.

Ms. Lewis reported that we continue to wait to hear from the Airport Authority about its intentions regarding the Kenneth Whitsett mural. Mr. Sullivan and Dr. Morrill agreed to speak with authorities concerning the matter.

Item #8 - Treasurer’s Report: Ms. Smith

Ms. Smith reviewed finance matters with the HLC. She said that she will e-mail Commissioners and Staff about financial specifics concerning HLC Projects.
